1. Terms of Service
These Terms of Service ("Terms") govern your use of the Deal-Won website (the "Site") and any consulting, advisory, or automation-build services provided by Deal-Won ("Services"). By using the Site or engaging our Services, you agree to these Terms.
1.1 Services
Deal-Won provides AI-driven growth, automation consulting, and related implementation services. The specific scope, deliverables, timeline, fees, and payment terms for any engagement will be defined in a separate written statement of work or services agreement signed by both parties.
1.2 Fees & Payment
Fees and payment terms will be set out in the applicable statement of work. Invoices are due within the time stated in the agreement. Late invoices may accrue interest and Deal-Won may pause Services until amounts are paid.
1.3 Intellectual Property
Unless a statement of work says otherwise, Deal-Won retains ownership of all pre-existing materials, methodologies, frameworks, templates, and tooling used in the Services. Client retains ownership of its own data, content, and trademarks. Work product specifically created for Client under an engagement is licensed or assigned to Client as set out in the applicable agreement.
1.4 Client Responsibilities
Client is responsible for providing timely access to systems, information, and personnel; for the accuracy of information it provides; for backing up its own data; and for obtaining any consents required to process customer or employee data through AI tools.
1.5 Third-Party Tools
Deal-Won’s Services often involve third-party platforms (e.g., HubSpot, Shopify, OpenAI, Anthropic, Google, Meta, Twilio). Use of those platforms is governed by their own terms. Deal-Won is not responsible for outages, pricing changes, or policy changes made by third-party vendors.
1.6 Termination
Either party may terminate an engagement in accordance with the applicable statement of work. Fees for work performed through the effective date of termination remain due.
1.7 Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
2. Privacy Policy
This section describes what personal information Deal-Won collects through the Site and in the course of providing Services, how it is used, and the choices you have.
2.1 Information We Collect
- Contact information you provide when booking a call, sending an email, or engaging our Services (e.g., name, business email, company, phone number).
- Scheduling data collected by our booking tool (e.g., Calendly) when you book a call.
- Server logs. The Site runs no analytics or tracking scripts and sets no advertising cookies. Our hosting provider keeps standard server logs (e.g., IP address, browser type, pages requested) for security and reliability. If we add analytics later, we will update this page first.
- Engagement data shared with us by clients during projects, which may include CRM data, customer records, call and SMS transcripts, and other business information.
2.2 How We Use Information
- To respond to inquiries, schedule meetings, and deliver the Services you have engaged us to perform.
- To operate, secure, and improve the Site.
- To send occasional updates to clients or prospects who have opted in. You can unsubscribe at any time.
- To comply with legal obligations and enforce our agreements.
2.3 Sharing
We do not sell your personal information. We share information only: (a) with third-party service providers that help us operate the business (e.g., Google Workspace, HubSpot, Calendly, AI model providers) under appropriate confidentiality or data-processing terms; (b) as required by law; or (c) in connection with a corporate transaction, such as a merger or sale of assets.
2.4 Your Choices
You may request access to, correction of, or deletion of personal information we hold about you by emailing tomloebenstein@gmail.com. Depending on where you live, you may have additional rights under laws such as the California Consumer Privacy Act (CCPA/CPRA) or the EU General Data Protection Regulation (GDPR).
2.5 Cookies
The Site itself sets no cookies. Embedded or linked third-party services — our web font provider and our booking tool (Calendly) — may set their own cookies or log your request when you load or visit them, under their own policies.
2.6 Retention
We retain personal information only for as long as is necessary for the purposes described in this policy, to comply with legal obligations, or to resolve disputes.
3. AI & Data Use Disclosure
Deal-Won uses third-party AI and large language model providers (including OpenAI, Anthropic, and similar vendors) to build and operate automations for clients.
- We configure AI systems so that client and customer data are processed only for the purposes of the agreed engagement.
- Where reasonably available, we use enterprise or API-tier AI services that do not train their models on client data by default.
- AI-generated output may contain errors. Client is responsible for reviewing and approving any AI output used in production workflows, including outbound communication, customer-facing content, or regulated decisions.
- Clients are responsible for disclosing AI use to end customers where required by law, including calling and messaging regulations (e.g., TCPA, CAN-SPAM, state SMS consent rules).
4. Disclaimer & Limitation of Liability
The Site and any general guidance, case-study figures, and examples provided by Deal-Won are for informational purposes only. They are not a guarantee of any specific outcome, dollar amount, revenue lift, or cost savings for your business. Results depend on your market, product, team, and execution.
4.1 Results Claims
Case-study figures on the Site describe work actually performed for a named client. They are not illustrative ranges, and they are not industry benchmarks presented as our own results.
The 3× figure refers to one specific thing: Shopify storefront revenue at Mike’s Beverages & Liquors in the first month after its May 21, 2026 launch, measured against the legacy web store over the month immediately before it. That is the online sales channel only, not total company revenue. Mike’s has operated a retail counter and B2B accounts since 1959, and we do not claim credit for those.
It is one client’s result. It is not a prediction, a projection, or a promise that your business will see the same or a similar outcome.
The Site also notes that Mike’s is on target for $6.2 million in revenue in 2026. That figure is the client’s own full-company trajectory, published with its permission, and it is a projection, not a booked result. Most of that revenue comes from the retail and B2B business Mike’s built over decades — we do not claim credit for it.
Two other kinds of numbers appear on the Site and are not client results. Figures describing Tom Loebenstein’s background (for example, years spent closing enterprise deals and leading B2B revenue teams) refer to prior roles at other companies, not work performed by Deal-Won. Timelines on the Site (for example, a first automation live inside 30 days) are typical expectations drawn from our engagements, not commitments or guarantees.
4.2 Testimonials
Client quotes on the Site are genuine statements from the people named, published with their permission. We do not pay for testimonials, and no quote on the Site was given in exchange for compensation, a discount, or any other benefit.
4.3 No Professional Advice
Deal-Won is not a law firm, accounting firm, financial advisor, or medical professional. Nothing on the Site constitutes legal, tax, financial, or medical advice.
4.4 Limitation of Liability
To the fullest extent permitted by law, Deal-Won’s total liability arising out of or relating to the Site or any Services is limited to the amount actually paid by Client to Deal-Won during the three (3) months preceding the event giving rise to the claim. Deal-Won is not liable for indirect, incidental, consequential, special, or punitive damages.
